
Are calls from debt collectors stressing you out? Know your debt collection rights. The Fair Debt Collection Practices Act (FDCPA) is a federal law that says a debt collector cannot use unfair practices to collect a debt.
Specifically, the FDCPA defines how debt collectors can communicate with you. It also makes it illegal for them to be abusive, unfair, or deceptive when collecting debts. If a debt collector contacts you, be aware of the illegal tactics they may use.
Under the FDCPA, unfair debt collection practices include:
- Charging you interest or other fees in addition to the amount owed
- Claiming you’ll be arrested or face further legal action if you don’t pay
- Calling you more than seven times within seven days
- Making threats or using profane language
- Impersonating a lawyer or law enforcement
If you suspect a debt collector is using unfair practices, immediately report the violation to the Consumer Financial Protection Bureau.
